LA PROTECTION DE LA MARQUE EN RDC : POUR QUELLE DUREE ET DEVANT QUELLE INSTITUTION

Résumé
La marque est l’âme de l’entreprise, elle est dans les affaires le gardien des bons usages de la guilde des commerçants pour la protection tant des consommateurs que des entreprises elles-mêmes. Relativement à sa protection quant à la durée et l’institution conformément à la loi congolaise de la propriété industrielle, une précision s’impose. A propos de la durée de dix (10) ans prévue pour la protection des marques, il est question de déterminer le point de départ au comptage de la durée qui devrait commencer à courir dès l’attribution du numéro définitif à la marque ou au retrait du titre (certificat d’enregistrement) par le titulaire. Au sujet de l’institution appelée à connaître la protection des marques en RDC, face à la prolifération institutionnelle du système congolais de propriété intellectuelle, l’adéquation doit en principe tendre vers le Ministère de l’Industrie dans son Secrétariat Général à l’Industrie, dans le cas contraire, il sied de procéder à la création d’un office unique pour tout le système de propriété intellectuelle en RDC.
Abstract
The trademark is the soul of the company, and in business it is the guardian of the good practices of the guild of merchants for the protection of both consumers and the companies themselves. With regard to its protection in terms of duration and institution in accordance with Congolese industrial property law, a clarification is in order. With regard to the ten (10)-year term set for trademark protection, it is a question of determining the starting point for counting the term, which should begin to run when the definitive number is assigned to the trademark, or when the title (registration certificate) is withdrawn by the holder. With regard to the institution responsible for trademark protection in the DRC, given the institutional proliferation of the Congolese intellectual property system, the appropriate institution should in principle be the Ministry of Industry in its General Secretariat for Industry. Otherwise, a single office should be created for the entire intellectual property system in the DRC.
