      Partie de la doctrine fran\u00e7aise, la perception, en droit congolais, du bloc de constitutionnalit\u00e9 est diff\u00e9rente\u00a0: elle a sa substance du dispositif normatif et de la jurisprudence, de la Cour constitutionnelle. <\/em><\/p>

      Dubitative sur la question, la doctrine congolaise s\u2019offre une disette, ratant du coup l\u2019occasion d\u2019impulser la jurisprudence en construction et permettre de situer la supr\u00e9matie de la Constitution au c\u0153ur de l\u2019activit\u00e9 de la Cour constitutionnelle.<\/em><\/p>

      De quantification fluide, le bloc de constitutionnalit\u00e9 oblige de recourir \u00e0 une vari\u00e9t\u00e9 de recettes qui n\u2019ont de sens que si elles sont coll\u00e9es aux r\u00e9alit\u00e9s de chaque pays, son contenu restant toujours \u00e0 pr\u00e9ciser, au regard de la jurisprudence produite. Celle-ci ne doit pas se d\u00e9ployer en marge de la volont\u00e9 du constituant.<\/em><\/p>

      Part of the French doctrine, the perception, in Congolese law, of the constitutionality block is different: it has its substance from the normative device and the jurisprudence, of the Constitutional Court.<\/em><\/p>

      Dubitious on the issue, Congolese doctrine has been sparse, missing the opportunity to give impetus to the case law under construction and to place the supremacy of the Constitution at the heart of the Constitutional Court’s activity.<\/em><\/p>

      With its fluid quantification, the constitutionality block requires recourse to a variety of recipes that only make sense if they are tailored to the realities of each country.<\/em> This case law must not be developed in isolation from the will of the constituent.<\/em><\/p>
