      \u00ab\u00a0Le principe g\u00e9n\u00e9ral de la responsabilit\u00e9 p\u00e9nale du sup\u00e9rieur hi\u00e9rarchique a aujourd\u2019hui pris encrage en droit international p\u00e9nal et est int\u00e9gr\u00e9 dans plusieurs l\u00e9gislations nationales. Cette forme de responsabilit\u00e9 p\u00e9nale soul\u00e8ve plusieurs interrogations dans la mesure o\u00f9 elle n\u2019a pas pour fondement les actes positifs que commet le sup\u00e9rieur hi\u00e9rarchique. Elle donne g\u00e9n\u00e9ralement l\u2019impression d\u2019\u00eatre une responsabilit\u00e9 p\u00e9nale pour fait d\u2019autrui. Pourtant, le droit p\u00e9nal en g\u00e9n\u00e9ral ne sanctionne pas que des actes positifs. Il sanctionne \u00e9galement les omissions coupables, d\u2019autant plus que certaines personnes, compte tenu de la position qu\u2019elles occupent, sont tenues de par la loi d\u2019une obligation d\u2019agir<\/em>. C\u2019est donc dans l\u2019hypoth\u00e8se du manquement \u00e0 cette obligation que s\u2019inscrit le principe de la responsabilit\u00e9 p\u00e9nale du sup\u00e9rieur hi\u00e9rarchique (civils, militaires et personnes assimil\u00e9es) qui consacre une forme de responsabilit\u00e9 p\u00e9nale individuelle particuli\u00e8re et non une responsabilit\u00e9 p\u00e9nale du fait d\u2019autrui. <\/em><\/p>

      Cette \u00e9tude met en \u00e9vidence la contribution de la jurisprudence p\u00e9nale internationale dans le d\u00e9veloppement et la consolidation de cette forme de responsabilit\u00e9 p\u00e9nale individuelle \u00e9rig\u00e9e en un principe en droit international p\u00e9nal et re\u00e7ue dans les ordres juridiques internes. Elle d\u00e9montre par ailleurs que cette forme de responsabilit\u00e9 p\u00e9nale ne peut \u00eatre retenue \u00e0 l\u2019\u00e9gard des auteurs du crime d\u2019agression\u00a0\u00bb.<\/em><\/p>

      “The general principle of the hierarchical superior’s criminal liability has now taken root in international criminal law and has been incorporated into several national laws. This form of criminal liability raises a number of questions insofar as it is not based on the positive acts committed by the hierarchical superior. It generally gives the impression of being vicarious liability. However, criminal law in general does not only punish positive acts. It also punishes culpable omissions, especially as some people, given the position they occupy, are bound by law to act. It is therefore in the event of a breach of this obligation that the principle of the criminal liability of hierarchical superiors (civilians, military personnel and assimilated persons) comes into play, establishing a specific form of individual criminal liability rather than criminal liability for the acts of others. <\/em><\/p>

      This study highlights the contribution of international criminal case law to the development and consolidation of this form of individual criminal responsibility, which has become a principle of international criminal law and has been accepted in domestic legal systems. It also shows that this form of criminal responsibility cannot be applied to the perpetrators of the crime of aggression”.<\/em><\/p>
