          La marque est l\u2019\u00e2me de l\u2019entreprise, elle est dans les affaires le gardien des bons usages de la guilde des commer\u00e7ants pour la protection tant des consommateurs que des entreprises elles-m\u00eames. Relativement \u00e0 sa protection quant \u00e0 la dur\u00e9e et l\u2019institution conform\u00e9ment \u00e0 la loi congolaise de la propri\u00e9t\u00e9 industrielle, une pr\u00e9cision s\u2019impose. A propos de la dur\u00e9e de dix (10) ans pr\u00e9vue pour la protection des marques, il est question de d\u00e9terminer le point de d\u00e9part au comptage de la dur\u00e9e qui devrait commencer \u00e0 courir d\u00e8s l\u2019attribution du num\u00e9ro d\u00e9finitif \u00e0 la marque ou au retrait du titre (certificat d\u2019enregistrement) par le titulaire. Au sujet de l\u2019institution appel\u00e9e \u00e0 conna\u00eetre la protection des marques en RDC, face \u00e0 la prolif\u00e9ration institutionnelle du syst\u00e8me congolais de propri\u00e9t\u00e9 intellectuelle, l\u2019ad\u00e9quation doit en principe tendre vers le Minist\u00e8re de l\u2019Industrie dans son Secr\u00e9tariat G\u00e9n\u00e9ral \u00e0 l\u2019Industrie, dans le cas contraire, il sied de proc\u00e9der \u00e0 la cr\u00e9ation d\u2019un office unique pour tout le syst\u00e8me de propri\u00e9t\u00e9 intellectuelle en RDC.<\/em><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t

          The trademark is the soul of the company, and in business it is the guardian of the good practices of the guild of merchants for the protection of both consumers and the companies themselves. With regard to its protection in terms of duration and institution in accordance with Congolese industrial property law, a clarification is in order. With regard to the ten (10)-year term set for trademark protection, it is a question of determining the starting point for counting the term, which should begin to run when the definitive number is assigned to the trademark, or when the title (registration certificate) is withdrawn by the holder. With regard to the institution responsible for trademark protection in the DRC, given the institutional proliferation of the Congolese intellectual property system, the appropriate institution should in principle be the Ministry of Industry in its General Secretariat for Industry.
