      Le d\u00e9clenchement d\u2019une proc\u00e9dure d\u2019\u00e9tablissement des faits, repr\u00e9sente le pr\u00e9lude de toute action contentieuse qui en mati\u00e8re p\u00e9nale, est consid\u00e9r\u00e9e comme une activit\u00e9 judiciaire de recherche des preuves, activit\u00e9 qui permet de d\u00e9gager la responsabilit\u00e9 p\u00e9nale de l\u2019auteur de l\u2019infraction. Est un moyen efficace et rationnel de transformation des soup\u00e7ons et charges en une certitude suffisante. Elle en \u00e9lucide les faits, \u00e9tablit le d\u00e9roulement des hostilit\u00e9s ainsi que la naissance du conflit, pr\u00e9serve la preuve pour justice, identifie les personnes responsables et permet de les traduire en justice.\u00a0; mais l\u2019exp\u00e9rience acquise au cours de ces derni\u00e8res ann\u00e9es sur les diff\u00e9rentes situations de guerre que certains pays ont\u00a0 connu permet de retenir plusieurs principes et\u00a0 m\u00e9thodes que devraient suivre normalement toutes les personnes d\u00e9sireuses d\u2019assurer la fiabilit\u00e9 de leurs conclusions en vue de permettre \u00e0 l\u2019organe charg\u00e9 de poursuite qui, en \u00e9tant conscient des limites inh\u00e9rentes \u00e0 ce type d\u2019exercice, pourra \u00e9valuer l\u2019impact de ce rapport sur une \u00e9ventuelle responsabilit\u00e9 p\u00e9nale des auteurs ; d\u2019un notre c\u00f4t\u00e9 la pr\u00e9sence des acteurs impliqu\u00e9s dans la commission des faits. <\/em><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t

      The initiation of a fact-finding procedure represents the prelude to any contentious action which, in criminal matters, is considered a judicial activity of searching for evidence, an activity which allows the criminal liability of the perpetrator of the offense to be cleared. It is an effective and rational means of transforming suspicions and charges into sufficient certainty. It elucidates the facts, establishes the course of hostilities as well as the birth of the conflict, preserves the evidence for justice, identifies the persons responsible and allows them to be brought to justice. ; but the experience acquired in recent years on the various war situations that certain countries have experienced allows us to retain several principles and methods which should normally be followed by all those wishing to ensure the reliability of their conclusions in order to allow the body responsible for prosecution which, while being aware of the limits inherent in this type of exercise, will be able to assess the impact of this report on a possible criminal liability of the perpetrators; on our side the presence of the actors involved in the commission of the facts.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"
